By accessing and using BySelling.com ("the Platform"), you agree to be bound by these Terms & Conditions. These terms govern the relationship between BySelling Ltd, private vehicle sellers, and professional automotive dealers.

1. Nature of the Service

BySelling acts exclusively as a lead generation and intermediary platform. We connect private vehicle owners with professional buyers.

Important Disclosure: BySelling is not a motor dealership. We do not buy, sell, or take physical possession of vehicles. Any subsequent transaction takes place directly between the Buyer and the Seller.

2. Marketplace Protocols

For Sellers: Listing a vehicle is free. However, you agree to provide accurate data (Mileage, Condition, History). Misrepresentation may result in your listing being removed and your IP address being blacklisted.
For Dealers: Accessing seller contact details requires a Lead Unlock Fee. This fee is paid via your internal Dealer Wallet.

3. Dealer Wallet & Lead Refunds

Lead Unlock Fees (£/$) are non-refundable. By clicking "Unlock," you acknowledge that you are paying for the introduction to the seller, not a guaranteed vehicle purchase.

Refund Eligibility: Refunds are only issued if the seller’s contact details are proven to be non-functional (e.g., a disconnected phone number) at the time of unlock.
Currency: Marketplace fees are processed in GBP (£) for UK transactions and USD ($) for USA transactions based on your account region.

4. Automated Vehicle Data & API Disclaimer

BySelling utilizes official government databases (including the Driver and Vehicle Standards Agency (DVSA) and Driver and Vehicle Licensing Agency (DVLA) registries) as well as selected third-party data providers to automatically populate vehicle specifications, MOT histories, and mileage records based on Vehicle Registration Marks (VRMs).

While we strive for high accuracy, neither BySelling nor our data partners warrant the absolute accuracy, completeness, or reliability of this information. BySelling accepts no liability for technical errors, specification discrepancies, mileage inconsistencies, or model-year inaccuracies provided by these external sources. All automated data and resulting valuations are provided "as-is." Users must independently verify all vehicle details, service history, and physical condition during an inspection prior to completing any transaction.

5. Valuation Estimates

Any valuation generated by our Platform is a "Market Estimate" based on algorithmic data. It is not a legally binding offer to purchase. Market conditions, regional demand, and physical vehicle condition will ultimately dictate the final sale price.

6. Security & Prohibited Conduct

To protect our community, we implement a strict Security Firewall. The following actions will result in an immediate and permanent ban:

Attempting to scrape license plate data from our servers.
Utilizing automated bots to bypass payment gateways.
Sharing "Unlocked" lead data with unauthorized third parties.

7. Limitation of Liability

BySelling Ltd shall not be held liable for any financial losses, mechanical failures, or legal disputes arising from a transaction initiated on this Platform. We provide the connection; you provide the due diligence.
