1. Acceptance of Terms

By accessing and using BySelling.com, you accept and agree to be bound by the terms and provisions of this agreement. This includes your participation in our Lead Marketplace as either a Seller or a Buyer (Dealer).

2. Marketplace Service Description

BySelling.com acts as an intermediary platform connecting vehicle sellers with commercial buyers.

• Sellers: May list their vehicles for free. Personal contact information remains masked until a buyer "Unlocks" the lead.
• Buyers: Must pay a non-refundable "Lead Unlock Fee" to gain access to the seller's contact details.

3. Lead Unlock Fees & Refunds

Buyers acknowledge that the fee paid to "Unlock" a lead is for the provision of contact information only.

• BySelling.com does not guarantee that a lead will result in a successful purchase.
• Unlock fees are non-refundable except in cases of verified fraudulent listings or incorrect contact data, subject to our sole discretion.

4. Seller Responsibilities

Sellers agree to provide accurate vehicle descriptions, mileage, and condition reports. BySelling.com reserves the right to remove any listing that is deemed misleading, inaccurate, or suspicious without prior notice.

5. Valuations are Estimates

Any valuation range provided by our algorithmic engine is a market estimate only. It is not a legally binding offer. Final transaction prices are negotiated directly between the buyer and seller outside of our platform.

6. Limitation of Liability

BySelling.com is not a party to the actual sale transaction. We hold no liability for the physical condition of the vehicle, the completion of the sale, the transfer of funds, or any disputes arising post-unlock between the seller and the buyer.

7. Prohibited Conduct

Users are strictly prohibited from attempting to bypass our marketplace security protocols. Any unauthorized attempts to access masked seller data or exploit system vulnerabilities will result in an immediate permanent ban and may be reported to the relevant authorities via our security "Gatekeeper" logs.
